2 convicted in Norway of plotting terror attack (AP)

OSLO, Norway ? Two men accused of plotting to attack a Danish newspaper that caricatured the Prophet Muhammad were found guilty Monday of terror charges in Norway, the first convictions under the country's anti-terror laws.

The Oslo district court sentenced alleged ringleader Mikael Davud to seven years in prison and co-defendant Shawan Sadek Saeed Bujak to three and a half years.

Judge Oddmund Svarteberg said the court found that Davud "planned the attack together with al-Qaida."

A third defendant, David Jakobsen, was cleared of terror charges but convicted of helping the others acquire explosives. Jakobsen, who assisted police in the investigation, was sentenced to four months.

Investigators say the plot was linked to the same al-Qaida planners behind thwarted attacks against the New York subway system and a British shopping mall in 2009.

The case was Norway's most high-profile terror investigation until last July, when a right-wing extremist killed 77 people in a bomb and shooting massacre.

The three men, who were arrested in July 2010, made some admissions but pleaded innocent to terror conspiracy charges and rejected any links to al-Qaida.

During the trial Davud denied he was taking orders from al-Qaida, saying he was planning a solo raid against the Chinese Embassy in Oslo. He said he wanted revenge for Beijing's oppression of Uighurs, a Muslim minority in western China.

Davud, a Norwegian citizen, also said his co-defendants helped him acquire bomb-making ingredients but didn't know he was planning an attack.

Prosecutors said the Norwegian cell first wanted to attack Danish newspaper Jyllands-Posten, whose 12 cartoons of Muhammad sparked furious protests in Muslim countries in 2006, and then changed plans to seek to murder one of the cartoonists instead.

Bujak, an Iraqi Kurd, said the paper and the cartoonist were indeed the targets, but described the plans as "just talk."

Prosecutors had to prove the defendants worked together in a conspiracy, because a single individual plotting an attack is not covered under Norway's anti-terror laws.

During the trial, prosecutors presented testimony obtained in the U.S. in April from three American al-Qaida recruits turned government witnesses.

Jakobsen, an Uzbek national who changed his name after moving to Norway, provided some of the chemicals for the bomb, but claims he did not know they were meant for explosives. Jakobsen contacted police and served as an informant, but still faced charges for his involvement before that.

The men had been under surveillance for more than a year when authorities moved to arrest them in July 2010. Norwegian investigators, who worked with their U.S. counterparts, said the defendants were building a bomb in a basement laboratory in Oslo.

The men had been under surveillance for more than a year when authorities moved to arrest them. Norwegian investigators, who worked with their U.S. counterparts, said the defendants were building a bomb in a basement laboratory in Oslo.

An Associated Press investigation in 2010 showed that authorities learned early on about the alleged cell by intercepting emails from an al-Qaida operative in Pakistan and ? thanks to those early warnings ? were able to secretly replace a key bomb-making ingredient with a harmless liquid when Jakobsen ordered it at an Oslo pharmacy.

The judge said it had been proven that Davud had contacts with al-Qaida in Pakistan, and that his notebook contained references to Saleh al-Somali, al-Qaida's chief of external operations, who officials believe helped organize the New York, Manchester and Norway plots. He was killed in a CIA drone strike in Pakistan in 2009.

During the trial, prosecutors presented testimony obtained in the U.S. in April from three American al-Qaida recruits turned government witnesses.

Greece should give up budget control: Germany (Reuters)

BERLIN (Reuters) ? Greece must surrender control of its budget policy to outside institutions if it cannot implement reforms attached to euro zone rescue measures, the German economy minister was quoted as saying on Sunday.

Philipp Roesler became the first German cabinet member to openly endorse a proposal for Greece to surrender budget control after Reuters quoted a European source on Friday as saying Berlin wants Athens to give up budget control.

"We need more leadership and monitoring when it comes to implementing the reform course," Roesler, also vice chancellor, told Bild newspaper, according to an advance of an interview to be published on Monday.

"If the Greeks aren't able to succeed themselves with this, then there must be stronger leadership and monitoring from abroad, for example through the EU," added Roesler, chairman of the Free Democrats (FDP) who share power with Chancellor Angela Merkel.

Reuters reported on Friday that Germany wants Greece to give up control of budget policy to European institutions as part of discussions over a second rescue package.

Greece, which has repeatedly failed to meet the fiscal targets set out by its international lenders, is in talks to finalise a second 130 billion-euro ($172 billion) package.

With many Greeks blaming Germans for the austerity medicine their country has been forced to swallow, officials in Athens dismissed the idea of relinquishing budget control as out of the question.

Finance Minister Evangelos Venizelos said on Sunday Greece was perfectly capable of making good on its promises.

"Anyone who puts a nation before the dilemma of 'economic assistance or national dignity' ignores some key historical lessons," he said in a statement before heading to Brussels for a European Union summit on Monday.

The Financial Times reported on Saturday that it had obtained a copy of the proposal showing Germany wants a new euro zone "budget commissioner" to have the power to veto budget decisions taken by the Greek government if they are not in line with targets set by international lenders.

"Given the disappointing compliance so far, Greece has to accept shifting budgetary sovereignty to the European level for a certain period of time," the document said.

Under the plan, Athens would only be allowed to carry out normal state spending after servicing its debt, the paper said.

Crushed by 350 billion euros ($462 billion) of debt and running out of cash quickly, Greece is scrambling to appease the "troika" of its official lenders - the European Commission, European Central Bank and International Monetary Fund - and stitch up a deal with private creditors simultaneously.

Greece needs to strike a deal with creditors in the next couple of days to unlock its next aid package in order to avoid a chaotic default.

A government source in Berlin said Germany's proposal was aimed not just at Greece but also at other struggling euro zone members that receive aid and are unable to make good on their obligations.

The European Commission, the executive arm of the 27-country bloc, said it wanted the Greek government to maintain autonomy.

NEW YORK (AP) ? J.C. Penney is permanently marking down all of its merchandise by at least 40 percent so shoppers no longer have to wait for sales to get bargains.

Penney said Wednesday that it is getting rid of the hundreds of sales it offers each year in favor of a simpler approach to pricing. Starting on Feb. 1, the retailer is rolling out an "Every Day" pricing strategy with much fewer sales throughout the year.

The plan, the first major move by Apple executive Ron Johnson since he became Penney's CEO in November, is different from Wal-Mart's iconic everyday low pricing. Unlike Wal-Mart, Penney's goal isn't to undercut competitors, but rather to offer customers more predictable pricing.

"Pricing is actually a pretty simple and straightforward thing," Johnson told the Associated Press during an interview ahead of the announcement at the company's Plano, Tex. headquarters. "Customers will not pay literally a penny more than the true value of the product."

Penney's plan comes as stores are struggling to wean Americans off of the profit-busting bargains that they have come to expect in the weak economy. The move is risky, though, because shoppers who love to bargain-hunt may be turned off by the absence of sales.

"The big question on investors' minds will be: 'How customers will react to a single price point versus a perceived discount under the old strategy?'" says Citi Investment Research analyst Deborah L. Weinswig.

Here's how Penney's pricing strategy will work:

? Sale prices become everyday prices. The company will use sales data from last year to slash prices on all merchandise at least 40 percent or lower than the previous year's prices. So, a woman's St. John's Bay blouse regularly priced at $14.99 could have the "Every Day" price of $7.

? Fewer sales. The retailer will pick items to go on sale each month for a "Month-Long Value." For instance, jewelry and Valentine's Day gifts would go on sale in February, while Christmas decorations would be discounted in November. Items that don't sell well would go on clearance during the first and third Friday of every month when many Americans get paid. Those items will be tagged "Best Prices," signaling to customers that's the cheapest price.

? New tags. The retailer used to pile stickers on price tags to indicate each time an item was marked down. But now each time an item gets a new price, it gets a new tag too. A red tag indicates an "Every Day" price, a white tag a "Month-Long Value" and a blue tag a "Best Price."

? Simpler pricing. Penney will use whole figures when pricing items. In other words, you won't see jeans with a price tag of $19.99, but rather $19 or $20.

? New advertising. Ads began airing Wednesday with a shopper screaming "No" to discounts as they look in their mailboxes, a pile of coupons and big sales signs. The company also has a new spokeswoman (talk show host Ellen DeGeneres) and logo (a red outline of a box that features JCP in the corner.) And a 96-page catalog will be mailed each month to 14 million customers, along with other promotional efforts.

The strategy, unveiled at Penney's investor meeting on Wednesday, comes as the retailer tries to turn around its business. Heavy discounting has hurt department stores like Penney. The group generates an average of about $200 per square foot, less than half the $550 or $600 stores like Victoria's Secret and Lululemon make per square foot, according to John Bemis, head of Jones Lang LaSalle Inc.'s retail leasing team.

But Penney has been a laggard even among department stores as its core middle-class customers have been among the hardest hit by the weak economy. It's also failed to attract younger customers even though its added hip brands like Mary-Kate and Ashley Olsen's teen clothing collection called Olsenboye. The stores also have been by Johnson himself describes as "tired."

For the 11 months through December, Penney's revenue at stores opened at least a year ? an indicator of a retailer's health ? rose 0.7 percent, while competitors like Macy's Inc. rose 5.4 percent, and Kohl's was up 1.1 percent. Penney posted a loss in the third quarter and cut its fourth-quarter earnings outlook after a disappointing holiday season when it had to heavily discount to attract consumers.

The new pricing caps months of speculation about what Penney's future might look like under the leadership of Johnson, a former Target Corp executive and the mastermind behind the success at Apple Inc.'s stores.

Johnson, who joined the company's board in August, already has put his stamp on the retailer. He has tapped former colleagues at Apple and Target to join him at Penney. That includes Target's top marketing executive Michael Francis to be Penney's president.

Johnson also is borrowing from the playbook of Apple, which shuns discounting and focuses on selling products and offering services.

In December, Penney said it will have homemaker doyenne Martha Stewart develop mini-shops starting next year. And during Wednesday's meeting, Penney executives outlined plans to in the next two years add Main Street, a series of 80 to 100 brand shops in stores similar to the Martha Stewart ones. It also plans to open areas in all stores called Town Square, a place that will offer services and expert advice, similar to Apple's Genius bars.

Perhaps the biggest challenge for Penney is to sell shoppers on its new pricing. For years, Penney, like many other stores, has propped up price. The intent: to make it look like shoppers are getting great discounts when items go on sale.

Penney has been an especially big promoter. Last year, the company, which offered 590 sales events last year, nearly three-quarters of its revenue come from merchandise that was discounted by 50 percent or more.

That's more than double the retail industry average. According to an estimate by management consultant firm A.T. Kearney, a typical retailer sells between 40 and 45 percent of its inventory at a promotional price, up from 15 to 20 percent a decade ago.

The increased discounting has been a vicious cycle that only feeds into shoppers' insatiable appetite for bigger and better discounts. In fact, whereas it took 38 percent off to get shoppers to buy 10 years ago, it now takes discounts of 60 percent, Johnson says.

At Penney, the regular price on an item that costs $10 to make rose 43 percent, from $28 in 2002 to $40 in 2011. But because of all of its sales and other promotions, what it actually ended up selling for rose only 15 cents, from $15.80 to $15.95 during that same period.

"I have been struck by the extraordinary amount of promotional activity, which to me, didn't feel like it was appropriate for a department store," Johnson says. "Once you start to promote, the only way to beat a promotion was to make it bigger."

Walter Loeb, a New York-based retail consultant, says Penney's new pricing is "visionary" and revolutionary."

But Charles Grom, a retail analyst at Deutsche Bank, says it will be difficult for Johnson to change shoppers' buying habits. Macy's, for example, cut back on coupons a few years ago, only to reverse courses after sales fell.

Palestinians take step toward elections, unity (AP)

GAZA CITY, Gaza Strip ? Palestinian political rivals Hamas and Fatah on Tuesday took a first practical step toward elections and possible unity by opening an office for voter registration in the Gaza Strip.

Presidential and parliament elections are envisioned for late spring, though a date has not been set. Elections are at the center of reconciliation efforts between the Islamic militant Hamas and Fatah, the movement of internationally backed Palestinian President Mahmoud Abbas.

Hamas won parliament elections in 2006 and wrested control of Gaza from Abbas by force a year later, leaving him with only the West Bank. The Gaza office of the Central Elections Commission was closed after the 2007 takeover and reopened Tuesday.

Updating Gaza voter records is a key part of election preparations, which officials have said would require several weeks. Elections could be held within three months of the completion of preparations. Abbas would set the date by decree.

In the West Bank, Israeli forces detained a Hamas lawmaker, the fifth such arrest in five days, prompting Hamas accusations that Israel is trying to sabotage the planned elections. Hamas has said it would only participate in elections if its candidates are safe from arrest by Israel.

"Every time we move toward reconciliation and reactivating the Palestinian parliament, we see Israel targeting our lawmakers in the West Bank," said Ismail Ashkar, a Hamas lawmaker.

Hamas said that in the latest incident, lawmaker Abdel Jaber Fuqaha was taken from his home in the West Bank city of Ramallah early Tuesday.

Israel's military confirmed the arrest but declined further comment.

Israel considers Hamas a terrorist organization. The group has carried out scores of deadly attacks against Israelis but has largely held its fire in recent years.

Currently, 24 of 45 Hamas legislators from the West Bank are in Israeli detention on charges of membership in an illegal organization, Hamas said. Hamas lawmakers have been subject to arrest by Israel since the group defeated Fatah in the 2006 election. Several lawmakers have been detained repeatedly.

Asked about the recent string of arrests, Israeli officials denied claims that they are politically motivated. The officials, speaking on condition of anonymity because they were not authorized to talk to reporters, declined further comment.

Palestinian peace negotiator Saeb Erekat, a leader in Fatah, condemned the recent arrests as a "flagrant act of aggression" that undermines prospects for peace. "With these actions, Israel exposes the farcical nature of its peace rhetoric," he said.

In recent months, Hamas and Fatah have tried to reconcile but have had trouble moving forward because of continued mistrust. Next week, Abbas is to meet with Hamas leader Khaled Mashaal in Cairo to try to break the impasse.

Iraq: Wave Of Car Bombings Hit Baghdad, Killing At Least 14

BAGHDAD -- A wave of car bombings hit the Iraq capital on Tuesday, killing 14 people and wounding more than 70 as violence surges in the country amid an escalating political crisis a month after the U.S. military withdrawal.

At least 170 people have died in attacks since the beginning of the year, many of them Shiite pilgrims attending religious commemorations. The last American soldiers left the country Dec. 18.

Suspected Sunni insurgents have frequently targeted Shiite communities and Iraqi security forces to undermine public confidence in the Shiite-dominated government and its efforts to protect people.

Tuesday's first attack targeted an early morning gathering of day laborers in Baghdad's Sadr City neighborhood. Police said eight were killed and another 21 wounded. Minutes later, an explosives-packed car blew up near a pastry shop in the same district, killing three people and wounding 26, police said.

Later in the morning, two more explosives-laden cars detonated, killing three and wounding 29 people.

A parked car bomb exploded near a high school at 10:30 a.m. in the predominantly Shiite neighborhood of Shula in northern Baghdad, killing two students and wounding 16 others, most of them also students, according to local police.

In the neighboring district of Hurriya, one person was killed when an explosives-packed car, parked along a busy commercial street detonated five minutes after the Shula blast, police officials said. Thirteen people were injured in that bombing.

Hospital officials in Baghdad confirmed the death toll. All officials spoke on condition of anonymity because they were not authorized to talk to the media.

While insurgents have carried out a number of deadly attacks in recent years, there is little indication so far that the country is slipping back toward the widespread sectarian bloodshed of 2006 and 2007.

Nonetheless, these recent attacks are seen as particularly dangerous because they coincide with both the departure of U.S. troops, as well as a political crisis pitting Shiite officials against the largest Sunni-backed bloc.

The political battle erupted last month after the Shiite-led government issued an arrest warrant against the Sunni vice president, Tareq al-Hashemi, on terrorism charges, sending him into virtual exile in the Kurdish autonomous region in northern Iraq. In protest, al-Hashemi's Sunni-backed Iraqiya bloc has been boycotting parliament and Cabinet sessions, bringing government work to a standstill.

Sunnis fear that without the American presence as a last-resort guarantor of a sectarian balance, the Shiite government will try to pick off their leaders one by one, as Prime Minister Nouri al-Maliki tries to cement his own grip on power.

Last week, the leader of the Sunni-backed Iraqiya bloc, Ayad Allawi, accused al-Maliki of unfairly targeting Sunni officials and deliberately triggering a political crisis that is tearing Iraq apart. Allawi, who is a Shiite, said Iraq needs a new prime minister or new elections to prevent the country from disintegrating along sectarian lines.

Iowa GOP now says Santorum won caucuses (AP)

DES MOINES, Iowa ? Offering no explanation, the Iowa Republican Party has declared Rick Santorum as winner of the Iowa caucuses, days after saying incomplete vote results precluded it from doing just that.

GOP State Chairman Matt Strawn and the party's State Central Committee issued a statement late Friday naming the former Pennsylvania senator as the winner, "in order to clarify conflicting reports and to affirm the results" that were released Wednesday.

The committee's release Wednesday said Santorum was 34 votes ahead of former Massachusetts Gov. Mitt Romney in the final certified results from 1,766 precincts. But because eight precincts never turned in certified results, Strawn said in the statement Thursday that the party could not declare a winner. He congratulated both Santorum and Romney. Sixteen days earlier, Strawn had announced that Romney had won the caucuses by eight votes.

Saturday's statement offered no explanation of what had changed since Thursday, and Strawn did not return calls seeking comment.

Two central committee members told The Associated Press that the group held a conference call Friday night to discuss the "confusion" about the results of the caucuses and directed Strawn to issue a statement making it clear that the party considered Santorum the winner.

"There had been too much confusion and we needed to clear things up once and for all," said Steve Scheffler of the Iowa Faith and Freedom Coalition, a committee member who was on the call.

Another committee member, Drew Ivers of Webster City, said the new statement declaring Santorum the winner was issued "to try to clarify the validity of the Iowa process."

Scheffler said there was no vote by the 17-member committee but it was clear from the call that the consensus was to issue the statement.

The certified results announced by Strawn on Thursday had Santorum with 29,839 votes and Romney with 29,805, a difference of 34. Ron Paul finished third with 26,036. Newt Gingrich finished fourth with 16,163 votes.

Unofficial election night results from the eight missing precincts gave Santorum 81 votes and Romney 46. If those results had been certified to state party officials by Wednesday's deadline, Santorum's lead in the final tally would have been 69 votes.

Primary day at hand, SC voters have their say (AP)

GREENVILLE, S.C. ? Primary day at hand, fast-climbing Newt Gingrich told South Carolinians on Saturday that he was "the only practical conservative vote" able to stop front-runner Mitt Romney in the GOP presidential race. Romney acknowledged the first-in-the-South contest "could be real close" and prepared for an extended fight by agreeing to two more debates in Florida, next on the election calendar.

Former Pennsylvania Sen. Rick Santorum braced for a setback and looked ahead to the Jan. 31 contest after getting the most votes in Iowa and besting Gingrich in New Hampshire. Texas Rep. Ron Paul made plans to focus on states where his libertarian, Internet-driven message might find more of a reception with voters; his campaign said it had purchased a substantial ad buy in Nevada and Minnesota, which hold caucuses next month.

The first contest without Texas Gov. Rick Perry, who dropped out this past week and endorsed Gingrich, was seen as Romney's to lose just days ago. Instead, the gap closed quickly between the Massachusetts governor who portrays himself as the Republicans best positioned to defeat President Barack Obama and Gingrich, the confrontational former House speaker from Georgia.

Romney avoided a run-in with Gingrich at Tommy's Country Ham House, where both had scheduled campaign events for the same time. Romney stopped by the breakfast restaurant 45 minutes ahead of schedule. When Gingrich arrived, just minutes after Romney's bus left the parking lot, he said: "Where's Mitt?"

Earlier, Gingrich had a message for voters during a stop at The Grapevine restaurant in Boiling Springs not long after the polls opened: Come out and vote for me if you want to help deny Romney nomination.

He told diners who were enjoying plates of eggs and grits that he was the "the only practical conservative vote" to the rival he called a Massachusetts moderate. "Polls are good, votes are better," he said.

Gingrich also said he would put a stop to federal actions against South Carolina's voter ID and immigration laws.

Romney's agreement to participate in Florida debates Monday in Tampa and Thursday in Jacksonville was seen as an acknowledgement of a prolonged battle with Gingrich.

"This could be real close," said Romney as he chatted on the phone with a voter Saturday morning and urged the man to go vote.

Romney still has significant advantages over his three remaining Republican rivals, including an enormous financial edge and a well-organized campaign.

But with his Iowa victory now rescinded, losing in South Carolina would be a setback that could draw the primary contest out much longer. Just 10 days ago, Romney's campaign team was looking ahead to the general election as it anticipated a quick sweep in early primaries.

By Saturday, state Treasurer Curtis Loftis, a top Romney backer, was on an automated telephone message attacking Gingrich's ethics record in Congress, while Romney's wife, Ann, was on a separate one urging voters to consider the candidates character.

"Look at how they've lived their life," she says. "And that's why I think it's so important to understand the character of a person."

Before the ham house standoff that wasn't, Romney stood outside his Greenville headquarters and undertook a new attack on Gingrich. He called on Gingrich to further explain his contracts with Freddie Mac, the housing giant, and release any advice he had provided to the company. He has said the contracts earned two of his companies more than $1.6 million over eight years, but that he only pocketed about $35,000 a year himself.

`I'd like to see what he actually told Freddie Mac. Don't you think we ought to see it?" Romney said.

It was another response to pressure on Romney to release his tax returns before Republican voters finish choosing a nominee.

A day earlier, Romney had called on Gingrich to release information related to an ethics investigation of Gingrich in the 1990s. Gingrich argues that GOP voters need to know whether the wealthy former venture capital executive's records contain anything that could hurt the party's chances against Obama.

Romney has said he will release several years' worth of tax returns in April. Gingrich has called on him to release them much sooner. On Saturday, Romney refused to answer questions from reporters about the returns and whether his refusal to release them had hurt him with South Carolina voters.

Gingrich, buoyed by Perry's endorsement as he left the race Thursday, has called Romney's suggestion about releasing ethics investigation documents a "panic attack" brought on by sinking poll numbers.

The stakes were high for Saturday's vote. The primary winner has gone on to win the Republican nomination in every election since 1980.

Some of South Carolina's notorious 11th-hour devilry ? fake reports in the form of emails targeting Gingrich and his ex-wife Marianne ? emerged in a race known as much for its nastiness as for its late-game twists.

State Attorney Gen. Alan Wilson ordered a preliminary review of the phony messages to see if any laws had been broken.

Gingrich's ex-wife burst into the campaign this week when she alleged in an ABC News interview that her former husband had asked her for an "open marriage," a potentially damaging claim in a state where the Republican primary electorate includes a potent segment of Christian conservatives. The thrice-married Gingrich, who has admitted to marital infidelities, angrily denied her accusation.

Chevron appeals $18 billion ruling in Ecuador lawsuit (Reuters)

SAN FRANCISCO/QUITO (Reuters) ? Chevron Corp (CVX.N) has filed an appeal with Ecuador's National Court of Justice to review a judgment that the U.S. oil company pay $18 billion in damages for polluting the Amazon jungle.

Chevron was ordered by an Ecuadorian judge to pay the damages after a fraught legal battle that has lasted nearly two decades and looks like it will run longer.

The California oil company inherited the case when it bought Texaco a decade ago. Its appeal on Friday argues the lower courts violated Ecuador's constitution by refusing to take corrective action in response to what Chevron calls "extensive fraud and corruption" committed by the plaintiffs' lawyers and representatives.

Chevron said the original judgment, delivered last February by a lower Ecuadorian court in Lago Agrio, was based on faulty evidence and retroactive application of a law, while ignoring releases of liability granted to Texaco by Ecuador in the 1990s.

"Today's appeal gives the National Court of Justice an opportunity to correct the grave injustices that have occurred in this case," Hewitt Pate, Chevron's general counsel, said in a statement.

Plaintiffs have responded to the accusations by citing Chevron's own test data in documenting the pollution and arguing that Ecuador's release for Texaco did not prevent third parties from suing for damages.

In related litigation in New York, the plaintiffs also accuse the company of mishandling soil and water samples during the Lago Agrio trial by maintaining two different laboratories, based on testimony from a Chevron expert.

Along with the appeal in Ecuador, Chevron asked that it not be required to post a bond to prevent enforcement of the judgment during the appeal process, arguing that such a payment would violate Ecuador's obligations under an order issued last February by an international arbitration tribunal.

Pablo Fajardo, a lawyer for the plaintiffs, said the next step would be to see whether the Lago Agrio appeals court requires Chevron to pay.

"If it asks (Chevron) to pay a bond, and if it pays the bond, then only the bond can stop us from carrying out the sentence," Fajardo told Reuters.

Asked if the plaintiffs were looking at any country in particular where it could seek to collect the damages, he said they would first await the decision on the bond. "We haven't done anything, we don't have any plans yet," Fajardo said.

The entire case may be reheard far from both Ecuador and the United States. The arbitration tribunal in The Hague, operating under a U.S.-Ecuador treaty, ordered Ecuador to take all measures at its disposal to suspend enforcement of the Lago Agrio judgment until the arbitrators have their say.

The tribunal is expected to rule any day on the question of whether or not it has jurisdiction in the case.

There's Victoria's Secret's fashion show, and then there are Sony's gadgets promo videos. The latest one is of the Sony Xperia acro HD, essentially an Xperia S for the Japanese market, but without the new NXT design with the illuminated transparent strip around it, and offered in other colors than black and white.

And since the acro HD is destined for the Land of the Rising Sun, it is also waterproof, and Sony is placing a good emphasis on that throughout the clip. The HD display, its Mobile Bravia engine, and the 12MP Exmor R camera receive telling highlights of their abilities as well.

Those of you who plan on purchasing an Xperia S, might feast their eyes on its capabilities, illustrated in the video below, and revel in the fact that they will be getting the trendy transparent strip. If you're a road warrior who still needs all the features of a computer to be productive, HP has a netbook for you. The Pavilion dm1-3010nr (Verizon) ($769.99, $599 with two-year contract) uses Windows 7 as its operating system and has a decent screen, a full-size keyboard, and a performance-minded AMD Accelerated Processing Unit (APU) for handling computing and graphics tasks on your travels. It's also equipped with Bluetooth and a Verizon 4G modem that will get you online anytime, anywhere. The dm1-3010nr has quite a bit to offer, provided you're a user looking to do more work than play.

Design
Like a majority of netbooks wanting to keep costs low, the HP Pavilion dm1-3010nr has a plastic clamshell design. The difference here is that the lid and bottom are made of resin, which is sturdier and more refined than glossy plastics. The entire chassis weighs 3.43 pounds, putting it on the heavier end of the netbook category. At 2.98 pounds, the Acer Aspire One AO722-0828 ($349.99 list, 3.5 stars) is definitely one of the lightest in the class; the 3.05-pound Sony VAIO VPC-YB35KX ($549.99 direct, 3.5 stars) is about average.

The 11.6-inch widescreen on the dm1-3010nr is big enough for working comfortably in one program. The screen displays in 1,366-by-768 resolution, a standard among netbooks. There's a VGA webcam above the screen for video chatting. The adjacent chiclet keyboard provides a wonderful typing solution for users on the go. The Pavilion dm1-3010nr utilizes HP's ClickPad, a frustrating feature that the company has since done away with in its laptop lines and newer dm1z netbooks, as it tends to cause the cursor to jump. (We experienced that while we were testing this netbook, too.) One way to circumvent this issue is to use one-finger touch-to-click navigation.

Features
There's a 320GB hard drive inside the dm1-3010nr, which is small compared with the 500GB drives you'll find on the Aspire One AO722-0828 and Sony VAIO VPC-YB35KX. Like the Pavilion dm1z ($449 direct, 4.5 stars), however, the Pavilion dm1-3010nr's drive spins at a faster 7,200rpm, whereas the Aspire One AO722-0828 and VAIO VPC-YB35KX spin at a slower 5,400rpm. This difference in speed does affect overall performance, although on a small level. Unfortunately, a considerable amount of bloatware litters the drive, including shortcuts to Netflix, Hulu, and eBay on the desktop, Blio ereader, Bing Bar, Fences desktop organizer, and Times Reader. So, if you want a bloatware-free system, you'll have to set aside a considerable amount of time to clean off some of these extraneous programs.

The dm1-3010nr has the standard HDMI and VGA video outputs, three USB 2.0 ports, 802.11n Wi-Fi, and an SD/MMC card slot. There's also Bluetooth, for connecting your wireless peripherals. Finally, there's a built-in Verizon CDMA/LTE 3G/4G modem, for connecting to the Internet when you're working remotely; Verizon offers two data plan options, 5GB for $50 per month or 10GB for $80 per month. (For more information, see the "4G Performance" section below).

4G Performance
Tested in eight locations in Brooklyn, Manhattan, and Queens, New York, we found that the HP's built-in modem gave the dm1-3010nr a significant signal advantage over our Editors' Choice Pantech UML290 USB modem ($99.99-$249.99, 4 stars), which was connected to a Lenovo U400 laptop. Receive signal strength varied from -3 to -11dBm better than on the USB modem, with resulting average download speeds almost twice as fast: 8.62Mbps down compared with 4.86Mbps, with a max of 24.51Mbps rather than 10.20Mbps. On one test, we couldn't connect with the USB modem at all; the HP netbook pulled in a weak?but acceptable?signal.

Upload speeds were closer, with the USB modem actually besting the HP notebook at 6.82Mbps average speeds for the USB modem compared to 6.04Mbps for the HP. And in our Web tests, processor speed mattered more than which modem we used. The Lenovo's 2.4GHz Intel Core i5 processor let it load Web pages more quickly through curl than the HP's 1.6GHz AMD E-350, even though the Lenovo's USB modem got a weaker signal.

Computing Performance
HP Pavilion dm1-3010nr (Verizon) The dm1-3010nr utilizes AMD's E-350 APU, a 1.6GHz chip that has the CPU and graphics processors on the same die; it's also loaded with 2GB of RAM. The system garnered a score of 54 on SYSmark 2007 (an overall performance gauge). The VAIO VPC-YB35KX (AMD E-450) had the same results, but the Editors' Choice Pavilion dm1z and Lenovo IdeaPad S205 ($579.99 direct, 3.5 stars) each scored 57 with the same APU. The main differentiating factor between the three systems is the amount of RAM (the IdeaPad S205 has 4GB, the Pavilion dm1z has 3GB, and the Pavilion dm1-3010nr has 2GB).

Despite the Radeon HD 6310 discrete graphics in the APU, don't expect to do any high-end gaming on the dm1-3010nr. It will be able to play games like Torchlight, which has an option to scale-down its content for netbook computers, and it will run circles around systems using Intel's Atom processors, but don't expect much more than that. The main bonus of the graphics is the ability to accelerate video, Flash content, and Web pages (on supported browsers).

For netbooks, battery life is one of the biggest deciding factors. The dm1-3010nr's 55Wh battery lasted 6 hours 41 minutes in our MobileMark 2007 rundown test, enough to last through a coast-to-coast flight and then some. But you can do better: The dm1z, which has the same 55Wh battery, lasted 7 hours 8 minutes; and the Sony VAIO VPC-YB15KX/S ($599.99 list, 4 stars), loaded with a slightly smaller 54Wh battery, lasted 7 hours 53 minutes.

The HP Pavilion dm1-3010nr is a fine computing solution for business workers and other users who spend at least as much time traveling as they do chained to a desk. Verizon's 4G and standard 802.11n Wi-Fi will keep you connected wherever you are, and the netbook's battery life will get you through most of your workday. But if your job and life don't require you to be jacked into the Internet constantly, the Editors' Choice HP Pavilion dm1z is a better portable solution, especially if you're looking to go the cheaper route. You always have the option to buy a 4G modem for the dm1z later on. But if you're looking for an all-in-one wireless package the dm1-3010nr is one of the best options out there.

Millions of Filipino devotees defy terror warning (AP)

MANILA, Philippines ? Millions of Roman Catholic devotees paraded with a statue of Christ through the Philippine capital under a massive police cordon Monday after the president warned that terrorists might target the raucous annual procession.

The government did not have specific intelligence on a terrorist plot. Still, about 15,000 policemen, backed by hundreds of army troops, secured the three-mile (five-kilometer) procession route for the charred wooden Black Nazarene statue from seaside Rizal Park to a popular church in Manila's congested Quiapo district.

Air force helicopters stood by and cellphone service was blocked in procession areas to prevent its use to trigger bombs. Despite the president's warning, huge crowds of devotees wearing maroon shirts surged near the statue, believed to have healing powers.

"It's a choice between faith and fear," said Rodolfo Uy, 45, a polio victim whose 12-year-old son pushed him on a wheelchair to see the Black Nazarene. "I got nervous last night when I heard the news but my devotion was stronger."

Uy said he prayed for metal braces so he could walk and work again for his children.

President Benigno Aquino III announced in a hastily called news conference Sunday that several terrorists had been reported in the capital with plans to disrupt the procession, but that the threat was not high enough to cancel the procession and that police would work to keep it safe.

Defense Secretary Voltaire Gazmin said the threat, involving possible bombings by two groups of Muslim militants from the country's volatile south, prompted police to raid several suspected terrorist hideouts in the Manila area, but without any results.

Gazmin defended Aquino's decision to announce the threat on the eve of the procession despite the absence of a specific threat, saying it underscored the president's concern for public safety and racheted up massive security preparations.

Aquino's warning sparked one of the most elaborate security deployments for an event in the capital in recent years, but Gazmin dismissed criticisms of a security overkill.

"It's OK if it can be described as overreacting," Gazmin said. "But at least we won't be sorry."

The event got under way with a morning Mass by Manila Archbishop Luis Antonio Tagle at Rizal Park attended by about 3 million mostly barefoot devotees. The crowd was expected to swell to 9 million later in the day, police said.

After the Mass, where prayers were offered for victims of recent deadly floods, organizers brought the life-size Black Nazarene statue down from a stage to a carriage for a procession expected to last well into the night.

Dozens were hurt when a crowd surged forward to try to touch, kiss and dab their towels on the statue, toppling iron railings and pinning other devotees. The Red Cross said it treated more than 250 people with bruises and other minor injuries throughout the day, including some from the morning melee.

The carriage's wheels later broke, slowing the procession. Authorities said the parade might be cut short as it dragged on into the night.

In addition to hundreds of army troops, the military said it deployed 19 teams of explosive experts, 33 units with bomb-sniffing dogs, crowd-control squads and ambulances. It put a 500-member rapid reaction force and three helicopters on standby.

There were suspicions that attackers might come from two radical Muslim groups, including the al-Qaida-linked Abu Sayyaf, which is on a U.S. list of terrorist organizations for deadly bombings, kidnappings and beheadings.

The wooden statue of Christ, crowned with thorns and bearing a cross, is believed to have been brought from Mexico to Manila in 1606 by Spanish missionaries. The ship that carried it caught fire, but the charred statue survived and was named the Black Nazarene.

Some believe the statue's survival of fires and earthquakes through the centuries and intense bombings during World War II is a testament to its powers.

The Philippines is Asia's largest predominantly Roman Catholic nation.

With decades of disagreement under their belts, area oil and gas producers and the local potash industry are making preparations to move forward together after a nudge in the right direction from United States Secretary of the Interior Ken Salazar, who stopped through Carlsbad on Thursday.

Salazar, Bureau of Land Management Director Bob Abbey and Sen. Jeff Bingaman, D-NM, joined potash industry officials for a tour of Mosaic Potash's Number 5 shaft, where they watched as 280-million-year-old rock was exposed by a large driller.

Mosaic and Intrepid potash mine potassium chloride from the area and are the only companies in the world to mine a mineral referred to as K-Mag. Officials said 1.4 million pounds of product are mined each year, yielding half a million dollars.

Following the tour of the underground tunnels and operations, the Washington dignitaries sat down with local and state BLM staff, representatives from Mosaic, Intrepid, the Sandia National Lab and area oil produces, including Concho Gas, Yates Petroleum, Devon Energy Oxy and BOPCO.

"We are going to try to bring an end to the conflict that has plagued the area for three decades," Salazar said at the Potash, Oil and Gas Steering Committee meeting.

The longstanding conflicts between the two dominate southeastern New Mexico industries have resulted in lawsuits in the past, BLM Carlsbad Field Office Manager Jim Stovall said Wednesday.

The formation of the committee a year ago, co-chaired by John Smitherman with BOPCO and John Mansanti of Intrepid, has shed new light on technical solutions to begin resolving the conflicts.

"The steering committee marshals that in the right direction," Mansanti added.

Funding is one of the issues standing in the way of further cooperation between the two entities, said Mansanti, adding that there would be a lot of beneficiaries from the action.

"The country benefits from the resources harvested," he said. "Through the timing and technology aspects, we have to find positions that are favorable to both resource industries. Both industries have to give up a little, but both will gain a lot."

Smitherman said Sandia National Labs has recently been conducting studies on the area, including gas migration studies, to better understand how the oil and gas industry is related to the potash industry, and to create a design that will eliminate the risks involved with integrating the two major industries.

"Sandia can provide us with third party credibility," Mansanti said.

The local branch of the lab has also conducted enclave mapping and risk assessment surrounding the issue. Further geological information will be a key factor in developing the partnership, committee members said.

With the cooperation of the two industries, and the scientific assistance from the lab, Salazar concluded the meeting by suggesting a plan of action to get the ball rolling and create a timely resolution to the 30 year conflict.

His first suggestion was to include Jesse Juen, new NM BLM director, as another co-chair on the committee, and to expand the committee to include oil produces like Cimarex Energy, Conoco Phillips and Chevron.

The Secretary of the Interior also asked that the committee come up with changes to the secretarial order to incorporate the process and program discussed Thursday - and to have it accomplished by April 1.

After polling each oil and gas and potash industry representative, all were pleased with the secretary's course of action and moving forward together.

Salazar then continued his two-day trip through Colorado, Texas and New Mexico, to discuss jobs, economic benefits relating to tourism, energy, water and conservation in rural communities in the Southwest.

Jay K. Reisinger and Michael P. Gillespie, attorneys for Starlin Castro, have released a statement in the wake of the report that he has been accused of sexual assault:

We are aware of certain allegations that have been made against our client, Starlin Castro. We have thoroughly investigated this matter, and we are confident that these allegations are baseless.? Given the sensitive nature of this matter, we cannot comment any further.

That?s a little stronger than your typical denial in these cases, but obviously there?s more that needs to play out here.

And I hope this goes without saying, but please folks: let?s keep our heads about us in the comments. We all know how these conversations unfold on the Internet. Someone is going to say unfortunate things about Castro before any facts are known. Someone is going to say unfortunate things about the alleged victim before the facts are known. Someone else will make broader statements about sexual assault, date rape and all manner of things that, with a little thoughtfulness and prudence, they may not otherwise have said.

Not saying that anything other than the usual commenting guidelines apply, but really, let?s try to be thoughtful and respectful here, OK?

Another 17 Haitian Orphans Sue Fairfield University Over Sex Abuse

Another 17 orphans have sued Fairfield University and affiliated religious and charitable organizations for negligence over sexual abuse they say they suffered while living in a Haitian orphanage founded and operated by a celebrated alumnus of the Connecticut school who later was prosecuted as a pedophile.

Three additional suits were filed last year containing similar allegations of negligence arising from the abuse of destitute street children who were admitted to Project Pierre Toussaint, a school and orphanage in Cap Haitien founded by Fairfield University graduate Douglas Perlitz.

Perlitz was sentenced in 2010 to more than 19 years in prison for abusing boys at the non-profit orphanage and school, which was largely sponsored by private donations from individuals and groups with ties to the university.

Perlitz's prosecutors said he threatened to expel residents of his orphanage if they refused to submit to his sexual attacks.

Lawyers for the boys filing the new group of 17 suits said Perlitz served as director of Project Pierre Toussaint "under the auspices of Fairfield University, the Society of Jesus of New England (Jesuits), the Haiti Fund, Inc., and many other individuals, including Father Paul Carrier and Hope Carter, then a member of the Board of Directors of the Haiti Fund, Inc."

Parties to the suits were not immediately available to discuss them.

San Diego murder-suicide rocks Navy community

The two Navy fighter-jet pilots were in their prime, having made the cut into one of the military's most competitive programs.

Their deaths in a murder-suicide on New Year's Day has rocked the tight-knit community of Naval aviators as investigators try to find out what happened in the condominium on the picturesque peninsula of Coronado, an enclave of 24,000 just across the bay of San Diego that recorded only one homicide in 2010.

There were no eyewitnesses, investigators say, and they have found no motive yet for the eruption in gunfire that also killed one of the pilot's sisters and a 31-year-old man the group had just befriended at a nightclub only hours before the incident.

John Robert Reeves, 25, shot himself in the head, and the three others with him were murdered, the San Diego County Sheriff's Department said, citing autopsy results. Fellow Navy pilot David Reis, also 25, was killed by a gunshot wound to the torso, and his 24-year-old sister, Karen, suffered a gunshot wound to the head and chest, officials said. Matthew Saturley, 31, of suburban Chula Vista, was shot multiple times.

Sheriff's Capt. Duncan Fraser said there were no outstanding suspects in the case, and police have found no evidence indicating there was an exchange of gunfire, although he declined to say if Reeves was the shooter, explaining that "we don't have forensic evidence yet to say that definitively."

Reeves, of Prince Frederick, Md., and Reis, of Bakersfield, Calif., were both training as F/A-18 fighter pilots assigned to the Marine Fighter Attack Training Squadron 101 of the Third Marine Aircraft Wing at nearby Miramar Air Station.

Retired Naval pilot Steve Diamond said the case is shocking because it involves such high achievers.

"The first thing that most people think of even within the Navy community is how could such an enormously tragic thing happen involving people ... who are the cream of the crop, highly trained, highly educated, national assets basically," he said.

It takes years of training to get one's wings as a Navy pilot, and fighter-jet pilots are considered to be among the top in that group. They undergo a battery of rigorous physical, psychological and background tests before finishing the highly competitive program, Navy officials said. Their top-notch skills and mental toughness were featured in Hollywood's "Top Gun" ? parts of which were filmed at Miramar.

The two Naval officers were in the final rung of that training.

"The hardest thing you ever do in aviation is carrier landing aboard a ship at sea, so these guys were the pick of the litter," said Ernie Christensen, a retired rear admiral and former Vietnam fighter pilot who commanded the Navy's Top Gun fighter school for a time in the 1980s.

"I will tell you that Naval aviation will hurt regardless of what anybody finds out about anything because they're all close, because you go through a tough, rigorous kind of a ritual," he added.

Reeves' family members could not be immediately reached for comment.

The two Navy pilots lived at the condominium with another Navy pilot who was out of town at the time. Friends and family members say they were not aware of any problems in the household, investigators said.

Military officials have been assisting the investigation but would provide no details on the two pilots or the training or psychological tests they had been undergoing, saying it was too early to do so in the probe.

Authorities were awaiting toxicology results to see if drugs or alcohol might have played a role.

Reeves moved in to the condo a few months ago, Fraser said.

Pilot ran inside when he heard gunshots
The two Navy pilots and Karen Reis went out to a nightclub on New Year's Eve with another unnamed friend, Fraser said. At the club, they met Saturley and returned to Coronado shortly after 2 a.m., reported The Los Angeles Times. When gunshots rang out 20 minutes later, the friend was talking to David Reis outside the condo, Fraser said. Reis rushed inside and the friend stayed outside and called 911.

David Reis' body was found near the entryway, Fraser said. Officers withdrew and established a perimeter around the building, and the county SWAT team was called in.

A robot was sent in to the multi-apartment structure to determine whether there was an active shooting suspect on the first floor. When none was found, the SWAT team went in and found three more bodies were on the third floor of the condo, including two in the bedroom and one on a landing. Investigators seized four guns; none appeared to be a military firearm, Fraser said.

Only one weapon appears to have been used, but officials have not been able to identify a motive. Any suggestion that Reeves was jealous of attention shown by Karen Reis to Saturley is only speculation, Fraser said at a news conference, The LA Times reported.

"At this point we do not have a motive for these shootings," Fraser said. "There were no eyewitnesses."

The friend who David Reis was speaking with outside is not considered a suspect, officials said. He called 911 and did not enter the home, said The LA Times.

Saturley attended the University of Maryland, earning a bachelor's degree in economics, before studying for a master's at MIT's Sloan School of Management, according to U-T San Diego. He has a 5-year-old daughter and had filed for divorce from his wife of nearly six years just three days before his death, U-T San Diego reported.

The Reis siblings were close friends, their parents say. His sister, Karen, 24, graduated from the University of California, San Diego in 2009, and coached volleyball twice a week to children 12 and younger.

Karen's absence will be greatly felt by those who came in contact with the "selfless young woman" who loved to play sports and sing in her car. David was Karen's "knight in shining armor," the family said in a statement Wednesday.

"We will miss David tremendously, but take solace knowing that he is now forever flying in flawless formation across eternity, with Karen on his wing," the family said.

Funeral services for David and Karen Reis are scheduled Saturday in Bakersfield. A memorial for Karen is being organized on the UCSD campus next week.

Hazen wrestling team taking to the mats hoping to raise awareness for pancreatic cancer

A year ago, Hazen wrestling coach Rory Magana?s father Rodney sat on the sideline and watched as the Highlanders faced off in a double dual. This year the same event will be held at Hazen, but the seat will be empty.

Diagnosed with pancreatic cancer in October 2010, Rodney passed away at 55 years old June 18, 2011. It?s because of that loss that Magana has turned the double dual match into the Pancreatic Cancer Awareness Night at Hazen Jan. 13.

?A big part of the problem is that there isn?t much awareness,? Magana said. ?With awareness comes funding and with funding comes improvement.?

The double dual wrestling tournament features the Highlanders, Oak Harbor, Highline and Chief Sealth. Doors open at 5 p.m. and donations will be accepted at the door for the entry fee. There will be informational booths set up, a bake sale and other small fundraising items. Magana will give a short introduction speech and the wrestling will start at 6 p.m.

?It will be on a smaller scale since it?s our first year,? Magana said. ?We?re just aiming for raising awareness and a little bit of funding.?

Despite being the fourth-leading cause of cancer-related deaths in the United States, just two percent of the National Cancer Institute?s research budget went to pancreatic cancer research in 2010, according to the Hirshberg Foundation for Pancreatic Cancer Research.

Treatment options are limited unless the cancer is caught very early, which is unusual since there are few specific symptoms for pancreatic cancer. Surgical removal of the tumor is an option less than 20 percent of the time. Because of this, pancreatic cancer has the highest mortality rate of all major cancers at 94 percent within the first five years of diagnosis, according to the Hirshberg Foundation. It is one of few cancers for which the survival rate has not improved greatly in the past 40 years.

Numbers like these left Magana and his family in shock last October when his father was diagnosed with Stage 4 pancreatic cancer that had already spread to his liver.

?It feels like you?re just dropped out in the middle of the desert,? he said. ?Like you?re left for dead with no hope.?

Magana hopes that raising awareness, and then funding, will help the cause, so that others don?t have to go through the same frustrations.

?I remember when I was younger, breast cancer was almost like a death sentence,? Magana, 27, said. ?Now that?s changed and it all started with people being aware of the situation.?

Cops: Wis. man busted for 150-mile test drive

MADISON, Wis. ? One Wisconsin man?s idea of a test drive didn?t sit well with a Madison dealer after the 47-year-old motorist took the car on a 150-mile trip around Milwaukee ? and didn?t bring it back, police said on Thursday.

?The driver maintained that ?You just don't take it for a 15-minute test drive?,? Madison Police Officer Howard Payne said. ?In my opinion, his explanation was not reasonable ? because he did not bring it back.?

Madison police arrested Robert E. Clark on a charge of operating a motor vehicle with consent of owner on Dec. 30, Payne said.

The Milwaukee Journal-Sentinel was first to report the story

The dealer, A to Z Auto in Madison, called police after the man failed to return the?silver 2000 Nissan Altima he picked for a test drive, Payne said.

What happened in this case was the dealer was interrupted by customers and was unable to accompany Clark on the drive, Payne said.

?From our standpoint, we don?t get involved in an agreement with two parties,? Payne said. ?But off course, this person did not have consent to do what he did.?

Police said Clark drove the car to Milwaukee and returned to his home and not the dealership, both?in Madison. His "test" drive was about 150 miles, Payne said.

Clark told officers that he took the Nissan to Milwaukee to secure funds to actually pay for the car, and did have every intention of returning the vehicle the following day, according to the police report released Thursday.

But, police got to him first and spotted the Nissan parked outside his home.

Msnbc.com was unable to reach Clark or the dealership for comment.
